Government Benefit Fraud Case Resolved in NSW
Our client was charged with serious fraud offences after allegedly making multiple dishonest claims for government disaster relief payments during the COVID-19 pandemic and bushfire recovery period.
Case Background
The client, a young woman from regional NSW, was accused of submitting 34 fraudulent applications for government assistance. A total of 11 applications were approved, resulting in more than $104,000 being paid out.
The charges included 16 counts of dishonestly obtaining a financial advantage by deception under section 192E of the Crimes Act 1900 (NSW).
Key Legal Challenges
The prosecution presented a large volume of documentary evidence, including:
Multiple online applications submitted using different personal details
IP address analysis linking submissions to one location
Banking records confirming receipt of funds
Defence Strategy
Our criminal defence lawyers reviewed the evidence in detail and developed a tailored strategy, including:
Arguing for the client’s cooperation and early admissions
Highlighting lack of prior criminal history
Presenting evidence of financial hardship and emotional instability
Our team also sought expert reports from psychologists to support a plea for leniency.
Outcome
After negotiations with the prosecution and detailed sentencing submissions, the client avoided a full-time custodial sentence. The court imposed a Community Correction Order (CCO) and ordered partial restitution of the funds.
This outcome allowed the client to remain in the community and rebuild her life while accepting responsibility for her actions.
Why This Case Matters
This case shows how complex benefit fraud matters require a strategic defence and compassionate understanding of a client’s background. Without proper legal representation, the outcome could have involved a lengthy prison term.
With the right team, even the most serious fraud allegations can be managed carefully, with an emphasis on rehabilitation and future prevention.
