Demerit Points Lawyers in Sydney
Accumulating too many demerit points can put your licence — and livelihood — at risk. At Best Criminal Lawyers Sydney, we help drivers challenge traffic offences, manage good behaviour licences, and avoid suspension by strategically addressing your demerit point situation in and out of court.
How the Demerit Point System Works in NSW
Every time you commit a traffic offence in NSW, you may incur demerit points. These accumulate over a 3-year period. Once you reach the limit, your licence may be automatically suspended by the RMS.
Licence limits before suspension:
13 points for unrestricted licence holders
7 points for professional drivers (bus, taxi, etc.)
4 points for provisional P1 drivers
7 points for provisional P2 drivers
If you exceed your point limit, the Roads and Maritime Services (RMS) will issue a suspension notice. You have the right to appeal — but strict time limits apply. We can help you respond quickly and effectively.
Can I Avoid Suspension with a Good Behaviour Licence?
Yes — if you elect a good behaviour licence instead of suspension, you’ll have 1 extra point over 12 months. But if you breach it, the resulting suspension period doubles.
Our lawyers can help you decide if the good behaviour option is worth the risk or if appealing your suspension is the smarter path. Learn more at the NSW Government Demerit Points page.
Demerit points add up fast — and so do the consequences.
Whether you’re facing suspension or driving on a good behaviour licence, we can help you reduce penalties, dispute infringements, and stay legally on the road.
How We Help You Avoid Licence Suspension
Our lawyers take a strategic, proactive approach to managing your demerit point situation. We don’t just lodge paperwork — we build persuasive cases that give the magistrate a clear reason to let you keep driving.
We assist with:
Appealing demerit-related licence suspensions in court
Advising on good behaviour licences and risks
Challenging fines or point errors on your driving record
Preparing supporting evidence for court, such as employment hardship
Explore appeal options on our Traffic Court Appeals page or see a detailed breakdown on Jameson Law – Traffic Law.
Impact on Your Job, Insurance and Family
Most of our clients rely on their licence for work, parenting duties, or medical access. A suspension could mean losing income, job termination or losing access to school drop-offs or elder care.
We present these factors clearly to the court to show that a suspension would cause disproportionate harm. When properly handled, even high-risk cases can be reduced — or avoided entirely.
What the Court Considers During an Appeal
Your driving history and whether you’ve improved
The seriousness of recent traffic offences
Steps you’ve taken to improve (courses, remorse, references)
Consequences of suspension on work or dependents

What our Clients Say
FAQs
Your Questions Answered
How many demerit points can I get before losing my licence?
The limit depends on your licence type. For unrestricted drivers, it’s 13 points in 3 years. P1 and P2 drivers have lower limits. Visit the NSW Demerit Points page for full details.
Can I appeal a demerit point suspension?
Yes. If the RMS suspends your licence for too many points, you may lodge a court appeal. See how we can assist on our Traffic Court Appeals page.
Is a good behaviour licence better than going to court?
It depends. A good behaviour licence gives you one more point over 12 months, but if you breach it, the suspension time doubles. Speak to our team to decide which path is best for your situation.
Can demerit points be removed from my record?
No, but they expire 3 years after the date of the offence. If there’s an error in your record, we may be able to challenge it. We cover this on our Demerit Points Lawyers page.
Can a lawyer really help with demerit-related suspensions?
Yes. A lawyer can argue for reduced or overturned suspensions, help prepare strong material, and advise on risks. For broader context, visit Jameson Law – Traffic Law.
